1. General

   By using Indiahandmade.com, you agree to the following terms and conditions:

   • You must be at least 18 years old to use Indiahandmade.com.
   • You must provide accurate and up-to-date information when creating an account.
   • You are in charge of everything that happens on your account.
   • You may not use Indiahandmade.com for any illegal or unauthorised purpose.
   • You shall not post any content that is defamatory, obscene or otherwise harmful.
   • You may not infringe on the copyrights or trademarks of others.
   • You may not use Indiahandmade.com to spam or harass others.
   • Indiahandmade.com reserves the right to terminate your account at any time for any reason.

   Indiahandmade.com may change these terms and conditions at any time. You need to go through the terms and conditions often to see if anything has changed. If you keep using Indiahandmade.com after the terms and conditions have changed, that means you agree to the new rules.

2. Membership Eligibility

   The Platform is restricted to users who are of legal contracting age as defined by the Indian Contract Act of 1872. People who aren't considered "incompetent to contract" under the Act include, for example, insolvents who have not yet been discharged. If you are underage, you need to have your parent's or legal guardian's permission and supervision to use the Platform or access any material on the Platform.
   If you are under 18 but would want to use the Platform to make a purchase, your parent or legal guardian must do so on your behalf. If it comes to Indiahandmade.com's attention or if it is found that you are less than 18 years and trading on the Platform, your membership may be terminated and/or access to the Platform may be denied.

3. The Platform for Transaction and Communication

   The Users use the Platform as a meeting place to do business with one another. No transaction between Users of the Platform may involve or be subject to the control of Indiahandmade.com. All future business/contractual terms will be presented and agreed upon solely between the Purchasers and the Vendors.
   Indiahandmade.com makes no promises or statements about the items or services that will be offered or purchased on the Platform, such as their quality, value, marketability and so on. Indiahandmade.com is not liable for non-performance or breach of any agreement between Buyers and Sellers.
   Indiahandmade.com does not acquire ownership of or any other rights or claims to, any of the products or services supplied by the Seller to the Buyer during the course of an agreement between a Buyer and a Seller on the Platform.
   Indiahandmade.com is not a party to any contracts between buyers and sellers. Indiahandmade.com does not own or have any control over the products that are sold on the Platform. Indiahandmade.com is not responsible for the performance of any contracts, including the delivery of products, the quality of products, or the satisfaction of buyers with products.
   Indiahandmade.com is also not responsible for delays or damages caused by products that are out of stock, unavailable, or back-ordered. Buyers should contact the Seller directly if they have any concerns about a product.
   Indiahandmade.com is a platform that allows users to buy and sell products or services. Indiahandmade.com is not a party to any contracts between buyers and sellers. The contract for the sale of any product or Service is a strictly bipartite contract between the Seller and the Buyer.
   Some products offered by sellers on the Platform may be eligible for business purchases. If you purchase such products for business purposes, you can claim ITC (Input Tax Credit) on the GST paid for the products. To claim ITC, you must request the Seller to issue you an invoice containing your GSTIN (Goods and Services Tax Identification Number).
   You must agree with the Seller on the terms and conditions of payment, delivery, insurance etc., before you make a purchase.

4. Payment Method

   As a buyer, the user understands and accepts that upon initiating a Transaction on the Platform, buyers enter into a legally binding and enforceable contract with the Seller to purchase the items from the Seller using online payment, which shall be paid to the Seller through their Issuing Bank. Buyer agrees and acknowledges that Indiahandmade.com is only a facilitator of collection and remittance of Transaction Price. No interest or benefits whatsoever is given to or can be claimed by the Buyer on the Transaction Price collected by Indiahandmade.com. We are not answerable for any loss or damage you may suffer as a consequence of utilising any of the Platform's payment methods. This consists of, but does not include, loss or damage resulting from:

   • There is no authorisation for any transaction(s).
   • Exceeding the predetermined limit mutually agreed upon by You and "Bank(s)".
   • Any payment complications that arise as a result of 
   • the transaction.
   • Transaction decline for any other reason(s).

   Seller may seek supporting documentation (including but not limited to government-issued ID and address verification) before shipping or delivering your order to you in order to confirm ownership of the payment instrument used for your transaction. This is done to offer Our Users a secure online buying experience.

5. Transactions

   The transaction price and all business conditions, such as delivery and dispatch of items and/or services, are governed by the principal-to-principal bipartite contractual responsibilities between Buyer and Seller. The payment function is simply utilised by the Buyer and Seller to enable the transaction's completion. The use of the payment facility does not make Indiahandmade.com liable or responsible for non-delivery, non-receipt, non-payment, destruction, breach of depictions and warranties, failure to provide after-sales or warranty services, or fraud in relation to the products and/or services listed on Indiahandmade.com's Platform.
   You have expressly permitted Indiahandmade.com or its service providers to collect, handle, facilitate and remit payments and/or the Transaction Price electronically, as well as from other Users, in connection with transactions conducted via the Payment Facility. Your relationship with Indiahandmade.com is principal-to-principal, and by accepting these Terms of Use, you acknowledge that Indiahandmade.com is a separate entity for all purposes and that Indiahandmade.com has no control over or liability for the products or services listed on Indiahandmade.com's Platform and paid for using the Payment Facility. Indiahandmade.com is not responsible for any User's identity, nor does it promise that a Buyer or Seller will finish a transaction.
   You, as a Buyer, understand that by beginning a Transaction, You have entered into a legally enforceable and legally binding contract with the Seller to acquire the Seller's goods and/or services using the Payment Facility. You must pay the Transaction Price to the Seller through your Issuing Bank using the Payment Facility.
   Refund shall be conditional and with recourse available to Indiahandmade.com in case of any misuse by Buyer. We may also ask for further documentation to verify your identity. Buyers must follow the policies to get a refund.
   Indiahandmade.com retains the right to decline to process Transactions by Buyers who have a history of uncertain charges, including, but not limited to, breach of any agreements with Indiahandmade.com, breach/violation of any law, charges imposed by the issuing bank or breach of any policy.
   In the event that Indiahandmade.com is prevented from executing a Transaction or Transaction Price for reasons beyond its control, the Buyer agrees that Indiahandmade.com will not be held accountable for any damages, interests, claims etc., that may arise as a consequence.

6. Buyer's Arrangement with Issuing Bank
   • In addition to the terms and conditions agreed upon between the Buyer and the associated Issuing Bank and payment tool issuing company, the processing of all Valid Credit, Debit, Cash Card, and other payment instruments is conducted through a Credit Card payment gateway or acceptable payment system infrastructure.
   • The Payment Facility uses the gateway provided by the issuing bank to handle all electronic funds transfers from Valid Bank Accounts. The terms and conditions agreed upon between Purchaser and the applicable Issuing Bank shall apply to any such Online Bank Transfers made using the Payment Facility.
7.  Non-Payment

   Buyers are not permitted to buy any product without making a payment of the Transaction Price on the Website Indiahandmade.com, in respect of the product as described in the listing.

8. Contact Information

   The contact details provided by Buyer on the Website should be correct and current at all times, and the Buyer shall be obliged to update any change in their contact information on the Platform immediately. Indiahandmade.com takes no responsibility for any delay/non-delivery of the goods on account of the failure of the Buyer to update the contact information provided on the Platform, and any consequent negative feedback by the Buyer will be deleted.

9. Feedback

   Buyer shall use the feedback and review mechanism to communicate fair and genuine opinions and facts in respect of any User, Buyer or Indiahandmade.com or overall experience whilst using the Platform, known from first-hand experience only. Buyer shall not include any hearsay information or information that results in maligning any User, brand or product in feedback. Indiahandmade.com prohibits the use of language that is racist, hateful, or obscene in nature in a public area.
   If Indiahandmade.com finds that a customer-posted review of a product includes objectionable language, as outlined above, it has the right to remove the review. Further, if Indiahandmade.com is of the opinion that the review unfairly either:
   (i) Causes a disadvantage to a product
   (ii) Increases the popularity of the product, Indiahandmade.com shall have the right to delete the customer review. In addition, Indiahandmade.com has the right to prevent the client from leaving any future reviews at its discretion.

10. Limit on the Volume of Transactions

    Indiahandmade.com reserves the right to limit the amount payable and the volume of the Transaction that may be conducted on a single Valid Card/Valid Bank Account by a Buyer and may refuse to process Transactions exceeding such limits and may also block certain Valid Cards or Valid Bank Accounts that are suspected to be misused while paying the Transaction Price.

11. Verification of Payment

    To prevent any misuse, a payment (in whichever method) of the Transaction Price initiated by the Buyer may be flagged or kept on hold for additional checks and verification.

12.  Order Confirmation

    The order, once placed, will be first received by the portal and forwarded to the Seller. Then, the order will be at the sole discretion of the Seller whether to fulfil the order or cancel the same under unavoidable circumstances or push the delivery timelines along with its corresponding intimation.
    ** Buyers’ patience is highly appreciated in these cases.

13. Delivery

    We try our best to deliver the order within the stipulated time, but in case of any exigency, the order may get delayed, and the same will be informed to the Buyer with an apology.
    Buyer shall immediately notify Indiahandmade.com upon non-delivery within 3 days of receiving the delivery confirmation message. If you fail to provide such intimation, it will be considered a Delivery for the purposes of that transaction, and the Transaction Price will not be refunded.
    If the Buyer fails to receive an item shipped on account of providing an inadequate or inaccurate shipping address or non-availability at the address provided, the transaction will be cancelled, and the item will be returned to the Seller, and Indiahandmade.com/seller shall be entitled to recover reasonable compensation for services provided and costs incurred in shipping, handling, dispatching, processing order and any other services provided to Buyer.
    Refunds will be made according to the return policy available on the portal and in your source account. 

14. Copyright

    Prior approval, express and written, shall be obtained from Indiahandmade.com for the use of the name, logo marks and intellectual property on the Platform, including promotional literature. Indiahandmade.com will take appropriate measures to protect the copyrights, trademarks, and other intellectual property rights of other stakeholders. 
    Indiahandmade.com is the owner and operator of this Website. However, each Seller is responsible for their own sales and customer service. Trademarks, copyrights and other intellectual property rights safeguard all content on this site, including photographs, graphics, audio clips and video clips. The content found on the Service is not to be used for any commercial purposes. Nothing you read here may be copied, replicated, republished, uploaded, posted, sent or distributed in any manner, including by email or other forms of electronic media. You are forbidden from helping anybody else violate this rule. Copyrights, trademarks and other proprietary rights are reserved, and you may not modify the materials, use the content on any other Platform or linked computer setting, or use the content for any reason other than your own personal, non-commercial use. For this provision, "commercial use" means any use for which you get compensation of any kind, whether monetary or otherwise.

15.  Severability

    If any part of this agreement is found to be invalid or unenforceable, the remainder and the application of the such provision to buyers or conditions other than the ones as to which it is deemed invalid or void will not be impacted consequently, and every clause of this agreement shall be valid, and the invalid and ineffective provision of this MoU will be replaced with a valid and ineffective provision.

16.  Indemnification

    Buyer agrees to indemnify and hold harmless Indiahandmade.com and its service providers against any direct or indirect liability arising from such violation. When a User or a Buyer makes a payment using funds from a Valid Bank Account, their transaction is processed via the gateway provided by the applicable Issuing Bank.

17. Product Description

    There is no guarantee that the information provided in the Product Description or elsewhere in this Platform is correct, up-to-date, complete or free of errors.
